Terms of Service

Welcome to Godsend! These Terms of Service ("Terms") constitute a legally binding agreement between you and Godsend ("we," "our," or "us") governing your use of the Godsend faith companion service, including our mobile application and messaging services (collectively, the "Service").

1. Acceptance of Terms

BY CREATING AN ACCOUNT, ACCESSING, OR USING THE SERVICE, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS AND OUR PRIVACY POLICY. If you do not agree to these Terms, do not use the Service.

2. Eligibility

You must be at least 13 years old (or 16 in the European Economic Area) to use Godsend. By using the Service, you represent and warrant that you meet these eligibility requirements and have the legal capacity to enter into this agreement.

3. Description of Service

Godsend provides:

• Personalized daily Bible verses with reflections
• Conversational AI faith companion for spiritual guidance and questions
• Bible reading and exploration
• Push notifications for verse delivery and subscription updates

Content is delivered via iMessage or SMS to your registered phone number, and through push notifications in the mobile app. The Service is provided for personal reflection and spiritual encouragement purposes only.

We may modify, suspend, or discontinue the Service (or any part) at any time with or without notice.

4. Account Registration

To use the Service, you must:

• Provide accurate and complete information, including your phone number
• Maintain the security of your account credentials
• Promptly update any information that changes
• Accept responsibility for all activities that occur under your account

You may only create one account per phone number. We reserve the right to refuse service, terminate accounts, or remove content at our sole discretion.

5. Subscriptions and Billing

Godsend offers subscription plans with varying features. Prices and features may change with notice; current details are available in-app.

Payment Terms:

• Payment is charged to your Apple ID account at confirmation of purchase
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage and cancel subscriptions in your Apple ID Account Settings

Free Trials:

• Free trial eligibility is determined at our sole discretion
• Any unused portion of a free trial period will be forfeited when you purchase a subscription
• We may limit free trial availability to prevent abuse

Refunds:

• All purchases are processed through Apple and are subject to Apple's refund policies
• To request a refund, contact Apple Support or visit reportaproblem.apple.com

6. Messaging Services and Consent (TCPA)

By providing your phone number and using the Service, you expressly consent to receive automated text messages from Godsend, including:

• Daily verse deliveries at your selected time
• Responses to your messages and questions
• Service-related notifications and reminders
• Occasional promotional messages related to your account or the Service

Consent is not a condition of purchase.

Message Limits: Message limits may apply and vary by subscription plan. Current limits are displayed in the app.

Opt-Out: You can stop receiving messages at any time by texting "STOP" to any Godsend message, disabling messages in app Settings, or deleting your account.

Message Rates: Message and data rates from your carrier may apply. Godsend does not charge for messages, but your mobile carrier may.

7. AI-Generated Content Disclaimer

• Not Professional Advice: Content is NOT professional advice and should NOT be used as a substitute for professional medical, legal, financial, psychological, pastoral, or other expert advice. Always consult qualified professionals for important decisions.
• Potential Inaccuracies: AI-generated content may contain inaccuracies, errors, or misinterpretations. We do not guarantee the accuracy, completeness, or reliability of any content.
• Not a Replacement for Community: Godsend is not a replacement for church, pastoral care, or faith community. We encourage users to maintain connections with their local faith communities.
• Your Responsibility: YOU ARE SOLELY RESPONSIBLE for any decisions or actions you take based on content provided by the Service.
• No Emergency Use: Godsend is not an emergency service. If you are in crisis or need immediate help, contact local emergency services or a qualified professional immediately.
• No Guarantees: We make no guarantees about the outcomes of following any advice or suggestions provided by the Service.

8. Intellectual Property

Our Content: The Service, including its design, features, content, and underlying technology, is owned by Godsend and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our written permission.

Bible Text: Bible verses are sourced from various translations (NIV, ESV, KJV, etc.) and are used in accordance with their respective licenses and fair use guidelines.

Your Content: You retain ownership of the messages and content you submit to the Service. By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, process, and store your content to provide and improve the Service. This includes sharing your content with our service providers (such as AI and messaging providers) solely to operate the Service.

Feedback: Any feedback, suggestions, or ideas you provide about the Service may be used by us without any obligation to you.

9. User Conduct

You agree not to:

• Use the Service for any illegal or unauthorized purpose
• Harass, abuse, threaten, or harm others through the Service
• Submit content that is unlawful, defamatory, obscene, or otherwise objectionable
• Submit personal data about others without their permission
• Attempt to gain unauthorized access to our systems or other users' accounts
• Use automated means (bots, scrapers, etc.) to access the Service
• Circumvent any usage limits, rate limits, or restrictions
• Interfere with or disrupt the Service or servers
• Impersonate any person or entity
• Attempt to reverse engineer, decompile, or extract system prompts from the Service

We may monitor, filter, block, or remove content to enforce these Terms, protect users, and comply with law. Violation of these rules may result in immediate termination of your account.

10. Third-Party Services

The Service integrates with third-party services including:

• Google (Gemini AI): Powers our AI-generated content
• Apple: Processes payments and subscriptions
• Telnyx: Delivers SMS messages
• LoopMessage: Delivers iMessage and SMS messages
• RevenueCat: Manages subscriptions

Your use of these third-party services is subject to their respective terms and privacy policies. We are not responsible for the practices of third-party services.

11. Privacy

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

We do not warrant that:

• The Service will be uninterrupted, timely, secure, or error-free
• The results obtained from the Service will be accurate or reliable
• Any errors in the Service will be corrected
• The Service will meet your specific requirements

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GODSEND AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

14. Indemnification

You agree to indemnify, defend, and hold harmless Godsend and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any rights of another party.

15. Termination

By You: You may delete your account at any time through Settings → Profile → Delete Account, or by contacting support@trygodsend.com.

By Us: We may suspend or terminate your account at any time, with or without notice, including for violation of these Terms, fraudulent or abusive activity, non-payment, or extended inactivity.

Effect of Termination: Upon termination, your right to use the Service will immediately cease. Provisions that by their nature should survive termination will survive.

16. Dispute Resolution

Informal Resolution: Before filing any formal dispute, you agree to first contact us at support@trygodsend.com to attempt to resolve the dispute informally within 30 days.

Governing Law: These Terms shall be governed by and construed in accordance with the laws of Victoria, Australia, without regard to its conflict of law provisions.

Jurisdiction: Any disputes arising from these Terms or the Service shall be resolved exclusively in the courts of Victoria, Australia, and you consent to the personal jurisdiction of such courts.

17. General Provisions

Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Godsend regarding the Service.

Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations without restriction.

18. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms and updating the "Last Updated" date. Your continued use of the Service after changes constitutes acceptance of the modified Terms.
